1. The following Terms & Conditions govern ALL transactions made between the customer and Regional Circular Distribution (hereinafter named as “The Company”).
2. Distribution will normally take place within the area(s) and on the date(s) specified (weather permitting). This does not necessarily imply 100% saturation of all addresses within the area(s)/postcode(s). Shareplan dates have to be flexible due to weather, other customer requirements planning or delays, delays in RCD sales performances. Not suitable for dated items
3. The Company offers a “guaranteed distribution or your money back” offer. The Company guarantees a minimum distribution of 98.5% penetration or accuracy, with 1.5% tolerance of a customer’s leaflets. Up to 10% of the customer’s leaflets may be distributed to an adjoining area(s) to your specified area(s) to ensure a minimum 98.5% penetration of your leaflets. Any agreed incorrect distributions, independently verified by area householders, and exceeding 2.5% of the customer’s order, will be refunded the cost of the incorrectly/ non-delivered leaflets. Printing costs are excluded from this guarantee.
4. The Company cannot guarantee, or be held responsible for, the level of response from any distributed advertisement.
5. The Company request that all leaflets are securely packaged in regular quantities which are clearly marked on the outer packaging.
6. All leaflets must be delivered to The Company’s address no later than the last working day of the week prior to distribution (unless by prior arrangement with The Company management).
7. The Company is under no obligation to check the quantity of materials supplied for distribution, but as far as reasonably possible, will notify the customer if the amount falls short or exceeds the agreed distribution quantity.
8. The Company cannot be held responsible for any costs, damages or other charges as a result of legal action or threatened legal action arising from publication and/or distribution of the customer’s advertisement.
9. The Company cannot be held responsible for any loss or damages arising from non-delivery or delays in distribution of leaflets for whatever reasons, i.e. costs, loss of business etc…..
10. The customer shall at all times be responsible for the insurance of all materials in the possession of The Company or its’ agents, whether for distribution or otherwise. Materials are at all times at the risk of the customer.
11. Cancellation of a booking can only be accepted if supplied in writing with 14 days notice
12. The Company reserves the right to sub-contract any part of an order.
13. Payment is required on a Pro Forma basis unless otherwise arranged.
14. All prices quoted by The Company are exclusive of VAT, which will be charged at the current rate.
15. All invoices are to be settled in full prior to delivery unless otherwise arranged. Cheques are to be made payable to Regional Circular Distribution (R.C.D.).
16. The Company reserves the right to charge a Late Payment Penalty on all unpaid invoices and to charge interest on all debts. We may pass on any unpaid invoices to our credit control company to recover the debt with all costs and interest to be charged to the customer.
17. In the case of non-payment and/or unsatisfied cheques, The Company shall be entitled to terminate an order without notice.
18. The Company is under no obligation to deliver material that is deemed to be in bad taste, a legal liability or considered to cause conflict.
19. The Company reserves the right not to distribute to any property and/or area(s) which are considered unsafe for distribution teams.
20. Backchecks are provided FOC if accompanied by customer ON day of delivery. Later date backchecks are chargeable. Customers own backchecks cannot be accepted as POD unless written dated householder signed and with prior invitation to be attended also by RCD if chosen.
21. Money back guarantee is conditional on both parties acceptable backchecks and only covers parts of contract agreed by both parties to be at fault/incorrect
22. Any refunds to be proportional to the size of query proven
23. The placing of an order shall amount to the customer’s acceptance of The Company’s Terms & Conditions.
